Changes to the current Terms
We keep the right to revise and modify these Terms. In such cases, we will do our best to notify you in advance, and you agree to be bound with such modifications. Any change is effective immediately after it is posted on the current webpage, and you agree to those changes when you continue using the Service. If you do not agree to the new Terms, you should stop using the Service.
The basics of using DOLIX
When using the Service, you agree to, in addition to these Terms, comply with the following:
a) Any legal rules of Discord: ToS, Privacy policy, etc.
(Note that we are not officially related to Discord in any way).
b) All applicable laws and other legal acts.
a) Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use and access the Service solely for your personal, non-commercial use.
b) DOLIX should only be used for what it is provided for. You are responsible for your use of the Service and must make sure that it does not violate any applicable laws, regulations, or third-party rights.
c) The owner reserves the right to take any appropriate actions to protect his legitimate interests, including the denial of access to the Service without any refund for any reason, including but not limited to a violation of the Terms.
d) We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
Authorized access to the Service
Most of the Service can only be accessed with the proper authorization. Currently, we only offer a way to authorize with a third-party account (Discord). By using your Discord account to authorize in the Service, you permit us to fully utilize the granted permissions and access any information you have given us access to. We may use that information in any way allowed by the law and all Discord's legal agreements, including the Discord Developer Terms of Service.We never store any data that may lead to your account being compromised (any account credentials) in long-term storage in an unencrypted way. If you are not satisfied with how your data is being used, you can request its deletion at any time by directly contacting the owner at the contact details provided elsewhere in this document. Furthermore, you are ultimately in control of how much access you grant us, and you can change it at any time by adjusting the "Authorized apps" settings of your Discord account.
Content in the Service
a) Unless otherwise specified or clearly recognizable, all content in the Service is owned or provided by DOLIX. You may not, therefore, use such content in any way that is not necessary for the use of the Service. In particular, but without limitation, you may not copy, download, modify, or create derivative works from the content of the Service, nor allow any third party to do so through your account or device, even without your knowledge, unless it is explicitly stated that you may download, copy, or share some content for your sole personal and non-commercial use, provided that all the attributions requested by the owner (including the copyright attributions) are correctly implemented.b) We respect others’ intellectual property rights, so we undertake our most efforts to ensure that all content in the Service does not infringe any applicable laws or third-party rights. However, it may not always be possible to achieve such a result, so:
1) We reserve the right to remove, delete, block or rectify any content alleged to be infringing and terminate the accounts of repeat infringers.
2) Without prejudice to any legal prerogatives of users to enforce their rights, anyone can report related complaints by directly contacting the owner.
c) DOLIX allows you to upload, share or provide your content to the Service. In such cases, you:
1) confirm that you are legally allowed to do so and that you are not infringing any statutory provisions or third-party rights.
2) acknowledge and accept that you grant DOLIX a non-exclusive, fully paid, and royalty-free license to process such content solely for the operation of the Service.
3) acknowledge, accept and confirm that all content is provided subject to the same general conditions for content in this Service.
4) agree that you are solely liable for the content you upload, post, share, or provide through the Service and that the owner does not filter or moderate such content but reserves the right to remove, delete, block or rectify it at his discretion and deny you access to the Service without prior notice if any infringement of intellectual property rights based on your content is noticed.
5) agree that the removal, deletion, blocking, or rectification of your content does not entitle you to any claims for compensation, damages, or reimbursement.
6) agree to hold the owner harmless from and against any claims asserted or damage suffered due to content you provided to or through the Service.
DOLIX Discord bot
The Service includes a DOLIX discord bot, and when interacting with it, you agree not to:
a) violate the terms mentioned elsewhere
b) use the bot for spamming purposes
c) place an unreasonable load on the infrastructure that may interfere with the proper working of the Service
d) get unauthorized access to any data (by crawling, scraping, etc.) in any way
e) copy or store any significant portions of the content
f) attempt to decompile, reverse engineer, or obtain the source code of the Services in any way other than directly asking the owner to provide it
DOLIX Website
The Service includes a website at https://dolix.xyz, and when interacting with it, you agree not to:
a) violate the terms mentioned elsewhere
b) place an unreasonable load on the infrastructure that may interfere with the proper working of the Service
c) get unauthorized access to any data (by crawling, scraping, etc.) in any way
d) copy or store any significant portions of the content
e) attempt to decompile, reverse engineer, or obtain the source code of the Services in any way other than directly asking the owner to provide it
f) locally change the source code of the webpage, including the changes that may affect the way the page works
One of the purposes of the website is setting up the bot, and while doing so, you agree that:
a) you have familiarised yourself with all the requirements and tips stated in the control panel
b) when saving the changes, you have ensured that all input corresponds to the defined limitations.
DOLIX is not responsible for any harm of any type incurred by attempting to save/saving incorrect values for any reason, including your misunderstanding of the established limits and attempting to interfere with the proper working of the Service.
Although we have implemented reasonable checks to ensure that only correct settings can be saved, it may not be perfect, and some values might still be interpreted or saved incorrectly,
and therefore may cause undefined behavior of the Service
Virtual Currency for exclusive use inside the Service
Some actions in the Service must be made using virtual currencies. Unless otherwise implicitly stated, the currencies are not tradable, exchangeable, redeemable, or refundable in any way.
By purchasing the virtual currencies, you:
a) acknowledge and understand that they may only be used within the Service for the purposes expressly authorized by DOLIX.
b) agree that you may not transfer, trade, sell, or exchange such virtual currencies outside of the Service and, accordingly, that you may not trade, sell, exchange,
or attempt to sell or exchange them for money or value of any kind outside of the dedicated offerings provided by DOLIX.
c) acknowledge that any prohibited use or transaction is considered null and void and can result in legal action taken against you.
Third-party services
We use third-party services to help us provide the Service, so DOLIX may contain links to third-party services, but such use does not indicate that we endorse them or are responsible or liable for their practices in any way. We may also link third-party services to facilitate the provision of our Service to you. If you use these links, you will leave the Service, and any access to and use of third-party services is not governed by these Terms but instead is governed by the Terms of those third-party services. So we are not responsible or liable for any harm incurred as a result of the use of any third-party services or the presence of any third-party advertising in the Service.
Disclaimer of Warranty
THE SERVICES ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SERVICE OR THE USE OR OTHER DEALINGS IN THE SERVICE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) IN NO EVENT WILL DOLIX BE LIABLE TO YOU OR TO ANY THIRD PERSON FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR OTHER INDIRECT DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE OR OTHER MATERIALS ON, ACCESSED THROUGH OR DOWNLOADED FROM THE SERVICE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES.
