Terms of Service of Dolix

These Terms of Service ("Terms") are a legal agreement between Dolix ("we", "us", "owner") and you ("you", "user"). By using the Dolix Discord bot or the Website at https://dolix.xyz, referred to as the "Service", "Software", or "Dolix", you warrant that you are legally authorized to use the Service and agree to comply with these Terms and any additional policies incorporated herein. When accepting these Terms, you confirm that no oral or written announcement conflicting with these Terms but not explicitly included in this document provided by us or any other party had impacted your decision except otherwise provided herein.

Changes to the Current Terms

We keep the right to revise, modify, and replace these Terms at our sole discretion. If we make any changes that significantly affect our practices, we will make reasonable efforts to notify you in advance, and you must get acquainted with such modifications. Any change is effective immediately upon posting on the current webpage, and you agree to be bound by those changes if you continue using the Service. If you disagree with the new Terms, you should stop using Dolix.

The basics of using Dolix

When using the Service, you agree to, in addition to these Terms, comply with any legal rules of Discord (Terms of Service, Privacy policy, and others) as well as all applicable laws and other legal acts. Please note, however, that we are not officially related to Discord in any way.

In no event shall the Owner be liable for any claims, losses, damages, or other liabilities arising out of or related to your misunderstanding or violation of these Terms, any laws or regulation of any jurisdiction, or the rights of any third party.

Acceptable use

Dolix should be used only for its intended purpose. The users are solely responsible for ensuring that their use of the Service violates no applicable laws, regulations, or third-party rights. The Owner reserves the right to take any appropriate actions to protect his legitimate interests, including denial of access to the Service without any refund for any reason, including but not limited to a violation of these Terms. In particular, when using the Dolix Discord bot or the Website, you agree not to:

Violate the terms mentioned herein and elsewhere in the Service;
Use the available features for any purpose other than for your own use, including spamming, offensive, unlawful, and abusive purposes, in particular by publishing or using terms that may be inappropriate;
Copy or store any significant portions of the content and transmit or attempt to transmit any copyrighted material without prior consent of the copyright owner;
Use any automated programs to access and use the Service;
Place an unreasonable load on the infrastructure that may interfere or attempt to interfere with the proper working of the Service, damage, disable, alter, overload, hack the Software, or otherwise circumvent the set constraints;
Attempt to decompile, reverse engineer, or otherwise obtain the source code of the Services in any way other than directly asking the Owner to provide it;
Get unauthorized access to any data by any means, including but not limited to crawling, scraping, etc.;
Introduce or attempt to introduce any viruses, trojans, or otherwise technologically harmful or malicious software into the Service.

Software License

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use and access the Service for the duration of your commitment to our Software and its updates solely for your own purposes. When using Dolix, you acknowledge that the Software is licensed but not sold to you, and no title or intellectual property rights are transferred to you under any agreement. The Software, including its source code, remains the property of Dolix, and all related intellectual property rights are reserved to Dolix and are protected by the applicable laws and international treaties unless otherwise explicitly stated. Thus, you may not copy, resell, or duplicate any portion of the Service without prior direct written permission of the Owner.

Authorized access to the Service

To access most features in the Service, you must log in with a third-party Discord account, and by doing so, you enable us to fully utilize the granted permissions and access any information you have given us access to. We may use that information in any way allowed by the law and our legal agreements with Discord, including the Discord Developer Terms of Service and the Discord Developer Policy.

We never store data that may compromise your account (any account credentials) in long-term storage unencrypted. You can learn more about our data practices in the Privacy and Cookie Policies.

If you are unsatisfied with how we handle your data, you can request its deletion at any time by directly contacting the Owner with the details specified in this document. Furthermore, you are ultimately in control of how much access you grant us, and you can change it at any time by adjusting the "Authorized apps" settings of your Discord account.

Content in the Service

Unless otherwise specified or clearly recognizable, all content in the Service is owned or provided by Dolix. You may not, therefore, use such content in any way that is not necessary to use the Service. In particular, but without limitation, you may not copy, download, modify, transform, sell, sublicense, or create derivative works from the content in the Service, nor allow any third party to do so through your account or device, even without your knowledge, unless explicitly stated otherwise elsewhere in the Service. In such cases, you may download, copy, or share some content for your own purposes, provided all the attributions, including the copyright attributions, are correctly implemented.

We respect others' intellectual property rights, so we do our best to ensure that all content in the Service does not infringe on applicable laws or third-party rights. However, it is not always possible to perfectly achieve such results, so:

We reserve the right to remove, delete, block, or rectify any content alleged to be infringing and terminate the accounts of repeat infringers.
Without prejudice, every User can report related complaints by directly contacting the Owner using the details provided in this document.

Content provided by Users

Dolix allows you to provide custom content to the Service. In such cases, you:

Confirm that you are legally allowed to do so and are not infringing any statutory provisions or third-party rights.
Acknowledge and accept that you grant Dolix a non-exclusive, fully paid license to process such content solely for the operation of the Service.
Acknowledge, accept, and confirm that all content is provided subject to the same general conditions for content in this Service.
Agree that you are solely liable for the content you upload, post, share, or provide through the Service and that the Owner does not filter or moderate such content but reserves the right to remove, delete, block, or rectify it at his discretion and deny you access to the Service without prior notice and refund or compensation of any kind if an infringement of intellectual property rights based on your content is detected.
Agree to hold the Owner harmless from any asserted claims and suffered damages resulting from the content you provided to or through the Service.

The control panel

The Dolix Website includes a control panel that lets you customize the behavior and appearance of the Discord bot, and by doing so, you agree that you have familiarised yourself with all the requirements and tips expressed in the interface. When confirming the changes, you must ensure that all inputs meet the specified constraints and acknowledge that Dolix is not responsible for any harm of any type incurred by attempting to save or saving incorrect values for any reason, including your misunderstanding of the established limits and attempt to interfere with the proper working of the Service. Although we have implemented reasonable checks to ensure that only the correct settings are stored, they may not be perfect, and some values may still be interpreted or captured incorrectly and, therefore, may cause undefined or unexpected behavior of the Service.

Paid access to the Service

Although we offer some features free of charge, others, the so-called premium ones, are accessible only on a paid basis, as indicated in the control panel. When purchasing those, you confirm that the fees are for the general use of the features and that we keep the right to revise and modify their content at our discretion without any reimbursement. Unless otherwise communicated before the order submission, the paid components are only made available within a small timeframe upon full completion of the transaction when we have received its total price.

Before the order submission, we inform the Users of the purchasing process, the overall list of paid features, and the total payment amount, including any fees, taxes, and discounts. When proceeding to the payment via one of the available third-party services, you confirm that you have verified the order and affirm its contents. Unless applicable law requires, Dolix does not offer any ways to cancel the payment and withdraw from the contract after you have completed the payment. In particular, no refunds can be issued for the past use of features.

Subscriptions

One way to access the premium features is to purchase a subscription for a determined period. The subscriptions start as soon as the payment is fully processed and last for the duration chosen by the User or specified otherwise during the order formation process. Once the subscription period expires, the corresponding features are no longer accessible. The User must pay the required fees periodically to maintain the subscription.

Monetization features

Some features allow administrators to monetize their community by selling virtual goods for real money. Once configured, the members can create orders via commands of the Dolix Discord bot. The remaining purchase process, however, happens on our Website and follows the general terms described herein. Most profits from such purchases are deposited to the server balance, which can then be used to enable premium features in the community.

Methods of payment

Dolix is ??not a bank payment agent but instead uses third-party services to implement payment options to enable paid features and other monetization opportunities. Therefore, Dolix does not collect and store any payment credentials, including credit card details, but only receives notifications from third-party providers once users complete the payments. If the third party rejects the payment, the Owner is not obligated to fulfill the order until the total price is received. In such cases, any possible losses and damages resulting from the failed payment shall be borne by the User.

Information about the accepted payment methods and any additional conditions is available on the checkout page during the purchase process. Dolix has no control over the content and practices of those third-party services and does not accept responsibility for their actions.

Discounts and special offers

Dolix may offer discounts and special offers for some purchases. Any such offer is granted at our sole discretion and does not entitle users to enforce it in the future.

Virtual Currency for exclusive use inside the Service

Some actions in the Service involve virtual currencies - non-monetary assets that enable access to specific parts of the Service under the conditions specified by the Owner. Currently, Dolix offers two types of virtual currencies: server balance that lets you enable premium features on a "pay-as-you-go" basis and coins that are an essential part of the in-app economics - one of the features offered in the Service.

Unless explicitly stated otherwise, the currencies are not tradable, exchangeable, refundable, or redeemable against any physical or digital currency, goods, and other values. By purchasing the virtual currencies, you:

Acknowledge that it may only be used within the Service for the purposes expressly authorized by Dolix.
Agree that you may not transfer, trade, sell, or exchange such virtual currencies outside of the Service and, accordingly, that you may not trade, sell, exchange, or attempt to sell or exchange them for money or value of any kind outside of the possibilities provided by Dolix.
Recognize that any prohibited use or transaction of virtual currencies is considered null and void and can result in legal action against you.
Understand that the Owner grants no refunds for any unused virtual currency forfeited resulting from account termination for any reason described herein.

Third-party services

We use third-party services to enable, improve, and facilitate the provision of our Services to you. Therefore, Dolix may contain links to external resources we do not operate. However, such use does not indicate that we endorse them or are accountable for their procedures in any way. We have no control over their content and practices and cannot accept responsibility or liability for them. Any access to and use of third-party services is not governed by these Terms but is instead governed by the Terms of those third-party services. Accordingly, we are not responsible or liable for any harm incurred by your use of third-party services or the presence of third-party advertising in Dolix.

Disclaimer of Warranty

The Services are provided "as is" without warranty of any kind, expressed or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. In no event shall the Owner be liable for any claims, losses, damages, or other liabilities, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Service or the use or any dealing in the Service. By using Dolix, you:

Acknowledge that your use of the Service is at your sole risk.
Agree that any fees are for the general use of the features, and any revisions or modifications in those are allowed at our sole discretion and do not entitle you to any repayment under any circumstances.
Accept that the Service may contain errors and defects, may be modified at any time at the Owner's sole discretion with or without notice, and may be subject to periodic downtime and unavailability resulting in total or partial loss or corruption of data.
Confirm that no oral or written announcement, information, or advice not expressly stated herein obtained from the Owner or through the Service does not create any warranty.

Limitation of liability

By accepting these Terms, you acknowledge that you are solely responsible for your usage of the Service and agree to ensure the security of configuration of the hardware and programs of the device used to access the Service. Although Dolix undertakes commercially reasonable precautions, any information you send or receive through the Software may be intercepted and acquired by unauthorized parties. You confirm that your use of Dolix is at your sole risk and that the Service may prove defective or vulnerable, exposing your information to the risk of leak or corruption.

To the maximum extent permitted by applicable law, under no circumstances and under no legal theory (including, without limitation, tort, contract, strict liability, or otherwise) in no event will Dolix be liable to you or any third party for any consequential, incidental, special, punitive or other damages, including any lost profits or lost data, arising from your use of the Service or other materials on, accessed through or downloaded from the Service, and whether or not we have been advised of the possibility of these damages.

If, notwithstanding anything contained herein, Dolix is for any reason found liable, the aggregate liability shall be strictly limited to the Service access fees charged to you during the last twelve months before the date of the document instituting the proceedings.
